What’s funnier, cancer or rape? That’s a trick question; neither is funny. And in the past 24 hours I’ve seen concerns for two Seth Rogen movies because of how they involve these unfunny subjects. Of course, I doubt the cancer comedy Funny People will turn as many people off as much as the date rape joke in Observe and Report.

If you’ve seen the red-band trailer for Observe and Report, you’ve seen the gist of the joke, which has Rogen pause mid-intercourse because he thinks Anna Faris’ character is unconscious. She’s apparently not, though, and scolds the guy for stopping. Yes, it’s black comedy, and yes, it makes sense as a joke in theory. But neither Faris’ seemingly conscious outburst nor the audiences’ laughter make it okay, according to some people who will not be going to see the movie this weekend or ever.

Few blogs are writing about the date rape issue surrounding the movie, but those that are have received a few interesting comments, all of which make me wonder if Observe and Report’s box office could be even slightly hurt by the joke. Certainly there have been successful films featuring total scumbag protagonists (Gran Torino is one example, though its character’s racism isn’t necessarily played for laughs), but does this one really appear to be saying that the scumbaggery is forgiveable in certain situations? After reading Faris’ thoughts, watching Rogen’s apologism and reading the comments below, let us if you’ll also be avoiding the movie as a result of its misogynous humor.

  • In the first of two posts on the issue, Sady at Tiger Beatdown complains, in response to the apologism of the punchline, that the film not just “contains, by all accounts, a scene of rape; it contains, by all accounts, a scene of rape in which the victim likes it and begs for more.” Commenter “antiplath” writes:

this movie sounds beyond horrid and I’m about to vomit just reading the description of the rape scene. Do people actually laugh at this? Really?

  • Quoting from Sady’s post, Melissa McEwan at Shakesville calls the film an “unmitigated clusterfuck” and calls Rogen “Rape Apologist #1.” Commenter “AnneOnne” asks:

Why is it that people would want to ban or belittle perfectly consensual, nuanced portrayals of human sexuality, yet find it acceptable, indeed ‘artistic’ to broadcast rape as entertainment or being ‘edgy’. We have serious problems with our attitudes to sexuality, humour and free speech.

  • Dan Kois at Vulture affirms that what Rogen’s character does is indeed rape, though in context, “this scene winds up seeming a lot less awful as the movie goes on.” Commenting in response to Kois’ inclusion of a justifying quote from Faris, “REBECCAROSE2004″ writes:

because I suspect many people will defend this by saying “Oh, well Anna Faris thought it was no big deal, and she’s a woman, so we shouldn’t care., I will say this…go rent a BRILLIANT film called “The Journals of Jean Seberg” directed by cinematic mastermind Mark Rappaport. Once you have seen his unflinching depiction of how carelessly women allow themselves to be used and abused just to claim the privelege of being part of the Hollywood scene, then I will be THRILLED to debate you on this issue. He frames it in a way that is more poignant and impactful than I ever would.

  • In her second post, which responds to the Vulture piece, Sady gets even more infuriated:

what we need to talk about is that the other crimes of violence in Observe & Report are just so much worse than rape, really, so women and rape victims should all just chill and agree to like the movie (even though, I am betting, it’s far more likely that a woman will be raped at the end of a date than that she will be killed or maimed by a comically insane mall security guard; I am also betting that the widespread social toleration of rape is far more likely to be reinforced by a joke that trivializes and justifies rape than the non-existent social toleration of murder is likely to be reinforced by a joke about murder)

  • Amanda Hess at The Sexist also lashes out at the joke being that “she just prefers to fuck while sleeping!” Commenter Brohem Can Sukkitwrites:

Rogen: “when we’re having sex and she’s unconscious…”

You’re not “having sex” when one of you is UNCONSCIOUS you disgusting piece of shit! Now I even regret just having rented Knocked Up. I’ll never see anything associated with this scumbag again. He Fatty Arbuckled himself here as far as I’m concerned.

well yeah, nothing sounds funny when you talk about it.

Well, on the bright side, if this inspires anything resembling a national discussion about the disgraceful and silent tolerance of date rape (and rape), then it’s not all bad.

It rarely makes sense to talk about a movie before you’ve actually seen it.

Thank you for writing this article.

I won’t be seeing this movie.

It’s really frustrating to discover (apparently due to living in a cave) that anyone (Rogen and co.) could think date rape is funny in any context.

Especially since one in six women will be raped or sexually assaulted in her lifetime. There was a controversial statistic a while back that the number is actually closer one in four.

Of course, there is another statistic that posits something like sixty percent of rapes go unreported. That controversial one-in-four statistic might not be so out there.

Movies like this, with this “unapologetic” rape apologism, will no doubt make it even harder for women to speak out, as Sady said.

And, to one of the commenters, it doesn’t sound “funny when you talk about it.” It’s not. It’s a cheap, demeaning and potentially damaging joke.

    I hope this starts a dialogue…

There really needs to be one.

wait, last time I heard its not rape if its consensual. Considering Rogens character stopped to see if she was unconscious makes it pretty obvious that if she had been unconscious then he would have stopped. And another question I have is if he had tricked her into being in the state that she was in or if she willingly took substances.

So this is probably a bad film for a first date?

derek: It does if the movie plays rape for laughs. Bet your ass I’m not putting my $10 behind that .

Chris: He penetrates her when she’s unconscious. That’s rape. No consent = rape. Make up a flash card if you need to.

I blame Judd A. He must have huge women issues “SuperBad”. Seth has now just become his robot so I don’t blame him as much.

I can speak about this with experience. This happened to me when my boss promised he would make sure I made it home ok from a X-mas party. I wound up loosing all of my friends at work, my career of 10 years and having a hard time finding a job since the industry is so small. This isn’t funny and I would like to see a boycot of this film and any other Judd A. Films.

“He penetrates her when she’s unconscious. That’s rape. No consent = rape. Make up a flash card if you need to.”

now now now, lets be mature about this.No need to try to insult. It doesnt make much sense to me that two people can be having consensual sex, then one passes out, then the other, unknowingly if the person actually is passed out, stops and asks the other person, and once stoped the person who “passed out” yells at the other person to continue, and then for some reason that person is called a rapist? now, I can understand if, they hadnt begun having sex in the first place, if he had tricked her into being in that state and if he had penetrated with knowledge of her being unable to consent, but thats not how it was.

No, no, no, no. Jesus, people—you sound like the Kristian Krazies who dived all over LAST TEMPTATION OF CHRIST without actually knowing what the movie was about.

A couple of points: 1) If you saw THE FOOT-FIST WAY, you know that Hill’s whole approach to filmmaking is to make his protagonists as bad as possible, and test the limits of what you’ll laugh at. So saying he’s “trying to make rape funny” is stupid—his whole point is that he wants to make you laugh at things that aren’t funny, which is why it’s interesting (if unsuccessful) comedy. 2)As noted in the comment by the (female) critic at Slate, they initiate sex when she’s conscious (albeit drunk, as she usually is in the film). When Rogen thinks she’s unconscious he stops. So it’s *precisely the opposite* of what y’all are insisting it is. http://slate.com/blogs/blogs/xxfactor/archive/2009/04/10/observe-and-consent.aspx

    Chris,

I know the flashcard comment seemed over the top to you. But this is an INCREDIBLY IMPORTANT concept, so please forgive me for joining the conversation.

As sexually active adults, it is our responsibility to expressly give consent or deny consent. As sexually active adults, we have the additional responsibility of only accepting consent from other capable adults. If someone has had so much to drink that they might pass out (like Brandi), they are not capable enough to give consent.

Please, in matters of rape and when discussing matters of rape, err on the side of caution. You would rather miss out on a night of sex than cause someone months, years, or a lifetime of trauma.

    The one in six,
    Jessica

So funny. The best scene in the film. It’s not the DATE RAPE that’s funny.. it’s her line that KILLS..

Sorry but I doubt any guy would think it were funny if the scene portrayed a gay guy having sex with a straight man that was passed out drunk without his consent. Then I think many of these guys and women that think that this is ok would think differently.

To be honest I don’t really care, I’m going to see this film anyway.

It’s a joke - They aren’t saying that date rape is a good thing or promoting it in anyway whatsoever.

I <3 Seth Rogen and Anna Faris.

They are both such funny people and i’m sure this movie will make me laugh.

It’s not like they can change what’s in the movie already… bit late don’t you think?
